General Terms and Conditions (“Küsnachter almond kisses”)

1. Conclusion of a contract

Please note that by sending the completed order form, you are making a binding offer to conclude a sales contract with “Küsnachter almond kisses”.

The customer bears sole responsibility for the selection of items. After submitting your order, you will receive an order confirmation by email. However this does not constitute an acceptance of your order. It is only intended inform the customer about the receipt of the order at “Küsnachter almond kisses”.

“Küsnachter almond kisses” then checks the feasibility, availability and, in the case of motifs submitted by the customer, the industrial property rights of any third parties. However, “Küsnachter almond kisses” does not assume any liability for the violation of the protection/copyrights of third parties in the case of motifs submitted by the customer. The order offer applies only to Switzerland.

 

2. Prices

All prices are listed in Swiss francs “Küsnachter almond kisses” is currently not subject to VAT. The invoice amount shall be based on the price of the goods at the time the order is received by “Küsnachter almond kisses”. No liability is accepted for incorrect price information (e.g. because of printing errors.

“Küsnachter almond kisses” reserves the right to change prices at any time. This can result from changes in the prices of ingredients or printing costs, for example.

 

3. Range of products

“Küsnachter almond kisses” may reject an order or withdraw from an order at any time. This does not require any justification on the part of “Küsnachter almond kisses”.

 

4. Delivery

Articles in stock will be shipped within 2–3 working days after receipt of payment. In the case of a larger order quantity, a delivery period of up to one week may apply. Delivery dates stated are generally non-binding.

The delivery costs are calculated from material (packaging), effort, and postage. These are assumed by the customer. The shipping is done via first class post. The minimum order quantity is 100 g.

The delivery takes place after receipt of payment.

“Küsnachter almond kisses” has no influence on the delivery time of Swiss Post. Non-compliance with the delivery date shall not entitle the customer to withdraw from the order or to claim damages. If Swiss Post is unable to execute an order confirmed by “Küsnachter almond kisses”, “Küsnachter almond kisses” shall not be obliged to carry out the delivery elsewhere.

This does not entitle the customer to any compensation. “Küsnachter almond kisses” doesn’t ship unpaid items.

5. Delivery fees

The delivery charges for each product are shown in the shop. The risk of the transport lies with the purchaser. The customer has no claim to replacement if the delivery is damaged or lost. If desired, shipping can be done by registered post. Additional costs per delivery: CHF 5 – the insured shipment must be requested by the customer in writing via email.

6 Payment

Each order is to be paid depending upon choice of the payment method (e.g. prepayment, at the latest 3 days starting from order and with an order by invoice, 14 days). Payment shall be deemed to have been made as soon as the entire invoice amount has been credited in full to the specified account. If payment is not made on time, “Küsnachter almond kisses” reserves the right to withdraw from the order. No payment reminders will be sent. After expiration of the three-day payment period, the order will expire. The shipping takes place after the shipping confirmation email.

6.1 Payment methods

• Invoicing

7. Warranty

“Küsnachter almond kisses” gives no guarantee on products ordered. This is because “Küsnachter almond kisses” is not able to verify the use of the product purchased by the customer and the care taken in opening the packaging.

8. Product information

All colours, sizes, and shapes may differ from the images on “Küsnachter almond kisses”.

9. Product weights

The indication of a product weight as well as the contents are found at the bottom of the packaging.

10. Copyright

“Küsnachter almond kisses” does not assume any liability in the case of violation of authors/names or other rights. These are passed on in full to the customer. If the customer has made false statements about the motif/author with the order and this results in a lawsuit, the customer must refund all costs incurred by “Küsnachter almond kisses”.

11. Amendments and additions

“Küsnachter almond kisses” expressly reserves the right to inform the customer of these General Terms and Conditions at any time, to adapt them to the circumstances, and to apply them immediately.
